1. About this Privacy Policy
We respect your privacy and are committed to handling personal information responsibly, transparently and in accordance with applicable Australian privacy laws.
This Privacy Policy explains how (BLANK) (ABN (BLANK)), trading as (BLANK), and operating the Moore River Brewing and Coral Coast Distillery brands (collectively, we, us or our), collects, holds, uses and discloses personal information.
This Policy applies to both brands, their websites, online stores, venue bookings, trade and distributor enquiries, functions and events, email marketing, customer communications, in-person transactions and other interactions with us. Information may be shared between Moore River Brewing and Coral Coast Distillery for the purposes described in this Policy.
2. What is personal information?
Personal information is information or an opinion about an identified individual, or an individual who is reasonably identifiable. It may include a name, postal address, email address, telephone number, transaction information, booking information or online identifier.
Some information, such as health information relating to allergies, dietary requirements or accessibility needs, may be sensitive information. We only seek this information when it is reasonably necessary to provide the requested service and, where required, with consent.
3. Personal information we may collect
Contact and identity information. Name, email address, telephone number, postal or delivery address, date of birth or age confirmation where relevant, and communication preferences.
Booking and hospitality information. Reservation date and time, party size, guest names where supplied, special requests, accessibility needs, dietary requirements, allergies, occasion details, seating preferences, booking history, cancellations, no-shows and communications about a reservation.
Purchase and transaction information. Products ordered, billing and delivery details, transaction identifiers, payment status, refunds, fulfilment details and customer-service history. Payment card information is processed by our payment providers; we do not ordinarily receive or retain complete card numbers or security codes.
Trade and business information. Business and trading names, ABN, business address, business contact details, job title, website, distribution territory, product interests, expected order volumes, liquor licence details and documents supplied with retailer, distributor or wholesale enquiries.
Marketing information. Newsletter subscriptions, marketing permissions, campaign interactions, preferences, feedback, competition entries and unsubscribe requests.
Employment, contractor and supplier information. Information reasonably necessary to consider applications, engage personnel or suppliers, administer working relationships and meet legal obligations.
Website and technical information. IP address, browser and device information, cookie identifiers, referring pages, pages viewed, date and time of access, approximate location derived from an IP address, shopping-cart activity and website interactions.
4. How we collect personal information
We generally collect personal information directly from you when you use our websites, make a booking or purchase, visit the venue, complete a form, subscribe to marketing, contact us by telephone, email or social media, enter a promotion, provide feedback, apply for work, or communicate with our staff.
We may also collect information automatically through our websites and cookies, or from service providers and third parties such as Now Book It, Squarespace, Stripe, ANZ, delivery providers, social media platforms, event partners and publicly available business sources.
If you provide personal information about another person, such as another guest or a business contact, you should ensure that you are authorised to provide it and that the person understands how it may be handled under this Policy.
5. Why we collect, use and disclose information
Bookings and venue services. To accept, confirm, change and manage reservations; communicate service information; accommodate reasonable dietary or accessibility needs; manage deposits, cancellations and no-shows; and provide hospitality services.
Orders and payments. To verify age where required, process online and in-store purchases, arrange delivery or collection, provide receipts, manage refunds, prevent fraud and maintain transaction records.
Customer and trade enquiries. To respond to questions, assess distributor and retailer applications, evaluate licences and suitability, provide wholesale information and administer commercial relationships.
Marketing and customer relationships. To send news, invitations, offers, product releases and other marketing where consent or another lawful basis applies; personalise communications; measure campaign engagement; and record marketing preferences.
Business administration. To manage suppliers, personnel, operations, accounts, insurance, security, quality, records, complaints, disputes and professional advice.
Compliance and protection. To comply with liquor, taxation, consumer, employment, health and safety, privacy and other applicable laws; respond to regulators and law-enforcement requests; and protect our rights, property, customers, staff and systems.
6. Reservations and Now Book It
We use Now Book It to provide and manage restaurant and venue reservations, maintain guest records and support customer communications. When you make a booking, information entered into the booking system may be collected by us and processed through Now Book It.
Now Book It may be used to send transactional communications such as booking confirmations, reminders, changes and cancellation messages. Where you have consented, we may also use booking and preference information to send marketing communications through Now Book It. Transactional booking messages and marketing messages are treated separately.
You can review Now Book It's own privacy information at nowbookit.com/privacypolicy.
7. Online orders, age requirements and alcohol sales
Online alcohol purchases are available only to persons who meet the applicable legal age requirements. We may request an age declaration or other evidence reasonably necessary to verify eligibility, prevent unlawful supply and meet liquor-licensing obligations.
An age-confirmation screen may store a cookie or browser value so that a visitor is not repeatedly asked to confirm their age. A website age declaration does not replace any identity or age verification required when alcohol is purchased, collected or delivered.
Our websites and alcohol products are not directed to persons under 18. We do not knowingly collect personal information from a person under 18 for alcohol purchasing or alcohol marketing. If we learn that such information has been collected inappropriately, we will take reasonable steps to delete or otherwise manage it.
8. Payments
Online payments are processed using Stripe. In-store card payments are processed using ANZ and relevant card networks or payment-system participants. These providers collect and handle payment and transaction information under their own privacy policies and security requirements.
We generally receive transaction confirmations, payment status, limited card details such as card type and the last digits, and information needed for reconciliation, customer service, fraud prevention and refunds. We do not ordinarily receive or store complete payment card numbers or card security codes.
Provider privacy information is available from Stripe and ANZ.
9. Email and direct marketing
We may send marketing communications about Moore River Brewing, Coral Coast Distillery, events, products, promotions and related offers where you have consented or where otherwise permitted by law. Because information is shared between the two brands, a communication may refer to either or both brands, consistent with the permission provided.
Submitting a general, booking or trade enquiry does not by itself subscribe you to marketing. Marketing consent should be provided through a separate optional choice. Service messages that are necessary to fulfil a booking, order or enquiry may still be sent even if you do not receive marketing.
You can unsubscribe using the link or instructions in a marketing message, adjust available preferences, or contact us. We will action unsubscribe requests within the period required by applicable law. Unsubscribing from marketing does not prevent essential transactional or service communications.
10. Cookies, analytics and website technologies
Our websites are hosted using Squarespace and may use cookies and similar technologies to operate the site, remember preferences and age confirmation, maintain security, support shopping and checkout functions, understand website performance and improve visitor experience.
Some cookies are necessary for website functionality. Other analytics or marketing technologies may be optional where consent controls are available. You can manage cookies through your browser and any cookie controls presented on our websites, although disabling some cookies may affect site functionality.
Squarespace's privacy information is available at squarespace.com/privacy.
11. Sharing between Moore River Brewing and Coral Coast Distillery
Information may be accessed and shared between Moore River Brewing and Coral Coast Distillery where reasonably necessary to operate the businesses, fulfil bookings and orders, coordinate events and trade relationships, provide customer service, maintain unified records, send marketing in accordance with your preferences and comply with legal obligations.
Both brands must handle shared information consistently with this Policy. We do not sell or rent personal information to third parties.
12. Other disclosures
We may disclose personal information where reasonably necessary to:
Service providers. Website hosting, booking and CRM providers, email and communications providers, payment processors, banks, delivery and logistics providers, cloud and IT providers, data-security providers, professional advisers, insurers and records-management providers.
Commercial partners. Authorised distributors, retailers, event partners or contractors where required to fulfil an enquiry, order, event or commercial arrangement and where the disclosure is appropriate.
Authorities and legal recipients. Government agencies, regulators, courts, law-enforcement bodies or other persons where required or authorised by law, or where reasonably necessary to protect rights, safety, property or systems.
Business transactions. A potential or actual purchaser, successor or adviser in connection with a proposed sale, restructure, financing or transfer of all or part of a business, subject to appropriate confidentiality and legal requirements.
13. Overseas handling of information
Some technology and payment providers operate globally and may store, process or allow access to personal information outside Australia. Depending on the service used, overseas recipients or processing locations may include the United States and India, as well as other countries in which a provider or its subprocessors operate.
For example, Squarespace is a global website platform and Stripe states that it may transfer personal data internationally, including to the United States and India. Now Book It operates in multiple countries and may use communications or technology providers in providing its services. Exact processing locations can change as providers update their infrastructure and subprocessors.
Where required by applicable law, we take reasonable steps appropriate to the circumstances before disclosing personal information overseas. Overseas recipients may be subject to privacy laws that differ from Australian law. Current information about a provider's handling practices should be checked in that provider's privacy policy.
14. Data quality, security and retention
We take reasonable technical, organisational and physical steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. Measures may include access controls, account security, staff confidentiality, secure service providers, system updates, backups and controlled disposal practices.
No internet transmission, electronic system or storage method is completely secure. You should use care when sending information online and should not send complete payment-card details or unnecessary identity documents by ordinary email.
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including to provide services, maintain business and transaction records, manage disputes, meet insurance requirements and comply with legal obligations. When information is no longer reasonably required, we take reasonable steps to securely destroy or de-identify it, unless retention is required or authorised by law.
If an eligible data breach occurs, we will respond in accordance with applicable data-breach notification requirements.
15. Accessing or correcting personal information
You may request access to personal information we hold about you or ask us to correct information that is inaccurate, out of date, incomplete, irrelevant or misleading. Contact us using the details in section 18 and provide enough information for us to identify the relevant records.
We may need to verify your identity before responding. In some circumstances, access may be limited or refused where permitted by law. If so, we will provide reasons where required. We will respond within a reasonable period and will not charge for making a request, although a reasonable administrative charge may apply where permitted for providing access.
16. Privacy complaints
If you believe we have not handled personal information appropriately, please send a written complaint to the privacy contact in section 18. Include your contact details, a description of the concern and the outcome you are seeking.
We will acknowledge and investigate the complaint and respond within a reasonable period. We may ask for further information where necessary. If you are not satisfied with our response and the Privacy Act applies, you may contact the Office of the Australian Information Commissioner at oaic.gov.au.
17. Third-party websites and services
Our websites may contain links to third-party websites, social media services, booking interfaces, maps or payment pages. Those third parties may collect information independently and their own privacy policies apply. We are not responsible for the privacy practices or content of third-party websites that we do not control.
